SUMMARY. The website www.karmadata.com (the “Site”) is brought to you by Karma Intelligence, LLC (“Karma Intelligence,” “we,” “us,” or “our”). This privacy policy (the "Privacy Policy") is intended to inform you of Karma Intelligence’s policies and practices regarding the collection, use and disclosure of information that you provide to us when you visit this Site. Unless otherwise defined herein, terms shall have the meanings assigned to such terms in the Terms of Use for the Site. This Privacy Policy is incorporated into, and part of, our Terms of Use which govern your access and use of this Site and/or services in general. If you have comments, suggestions, questions, or concerns about our Privacy Policy, please contact us.

1. INFORMATION WE COLLECT. Karma Intelligence collects and uses Personal Information as described in this Privacy Policy. "Personal Information" is information about you that is personally identifiable to you like your name, address, telephone number, and e-mail address. By accessing our Site and/or submitting Personal Information through the Site, you agree to the terms of this Privacy Policy and you expressly consent to the processing of your Personal Information according to this Privacy Policy. Karma Intelligence also collects Anonymous Information as described in this Privacy Policy. "Anonymous Information" means information that is not associated with or linked to your Personal Information; Anonymous Information does not permit the identification of individual persons. This information includes internet protocol addresses, browser type, internet service provider (ISP), site entry/exit pages, operating system, date/time stamp, and clickstream data. We use this information to improve our Site, analyze trends, administer the Site, track users' movements around the Site, and gather aggregate information about the Site user base as a whole from which individual identities have been removed.

2. HOW INFORMATION IS COLLECTED.  

  1. In order to become a user, you must provide us the following information to create an account: email address, user name, answer to a security question, and password. Without this minimal amount of information, you cannot create an account.
  2. Once you become a user, you may, in your sole discretion, provide additional Personal Information in your user profile describing yourself such as and including your skills, professional experiences, educational background etc. Providing additional information about yourself beyond what is minimally required at registration is entirely up to you, but providing additional Personal Information enables you to derive more benefit from the Site.
  3. We may also collect Personal Information when you interact with our customer service department in order to accurately categorize and respond to customer inquiries and investigate potential breaches of our terms.
  4. Like most websites, we use cookies and web log files to track site usage and trends, to collect information to improve the quality of our service, to customize your experience on the Site, as well as to deliver Karma Intelligence and third-party advertising to users both on and off the Site. A cookie is a tiny data file that resides on your computer, mobile phone, or other device, and allows us to recognize you as a user when you return to the Site using the same computer and web browser. You can remove or block cookies using the settings in your browser, but in some cases doing so may impact your ability to use the Site. One type of cookie, known as a “persistent” cookie, is set once you’ve logged in to your karmadata account. The next time you visit the Site, the persistent cookie will allow us to recognize you as an existing user so you will not need to log in before using the Site. Another type of cookie, called a “session” cookie, is used to identify a particular visit to the Site. Session cookies expire after a short time or when you close your web browser. karmadata may use cookie-equivalent technology to enhance karmadata’s services. In the course of serving advertisements or optimizing the Site for our users, we may allow authorized third parties to place or recognize a unique cookie on your browser. Any information provided to third parties through cookies will not be personally identifiable but may provide general segment information (e.g., your industry or geography, career field, or information about your professional or educational background) for the enhancement of your user experience by providing more relevant advertising. Most browsers are initially set up to accept cookies, but you can reset your browser to refuse all cookies or to indicate when a cookie is being sent. karmadata does not store unencrypted Personal Information in the cookies.
  5. We receive information when you interact with and use the Site. For example, we know when you create Views, open Views, make comments, search for Views, click on ads, and change your profile information etc.
  6. We may use ad technology such as web beacons, pixels, anonymous ad network tags, and cookies to more effectively serve ads to our users on and off the Site through ad networks, as well as to collect Anonymous Information, aggregated auditing, research and reporting for advertisers. Because your web browser requests advertisements and web beacons directly from ad network servers, these networks can view, edit or set their own cookies, just as if you had requested a web page from their site.
  7. Due to the communications standards on the internet, when you visit the Site we automatically receive the URL of the site from which you came and the site to which you are going when you leave the Site. Additionally, advertisers receive the URL of the page you were on should you click on an ad on the Site. The Site also receives the internet protocol (“IP”) address of your computer (or the proxy server you use to access the World Wide Web), your computer operating system and type of web browser you are using, email patterns, your mobile device (including your UDID) and mobile operating system (if you are accessing the Site using a mobile device), as well as the name of your ISP or your mobile carrier. The link between your IP address and your Personal Information is not shared with third parties without your permission, except as described in Section 6(C) below.
  8. We will retain your Personal Information for so long as your profile is active or as needed to provide you services and as otherwise set forth in this Privacy Policy. We may retain Anonymous Information indefinitely.

3. UNSECURED EMAIL WARNING. Please note that any information you send to us via email is sent via an unsecured email link. Due to the nature of the Internet, there is a possibility that unsecured (unencrypted) email could be intercepted and read by third parties. Karma Intelligence assumes no responsibility for interception of any information you send in an unsecured (unencrypted) email message.

4. HOW WE USE YOUR PERSONAL INFORMATION. The Personal Information we gather from you may be used for the following purposes: (i) to provide the Site to you; (2) to send you promotional communications; (3) to respond to your requests and inquiries, (4) to manage your registered user account; and (5) to notify you about important changes to our site, such as changes or updates to this Privacy Policy or our Terms of Use, security announcements or other similar messages. You acknowledge and agree that you will pay any service fees associated with your receipt of messages on your mobile device (including text message charges). We do not collect or maintain Personal Information for resale purposes, or share Personal Information with any other company or organization except as specifically disclosed herein.

5. OPT-OUT. If you decide at any time that you no longer wish to receive promotional communications from us, please follow the unsubscribe instructions provided in any of the communications. We will take commercially reasonable steps to implement your opt-out requests promptly, but you may still receive communications from us for up to ten (10) business days as we process your request. Please understand that if you choose not to receive promotional correspondence from us, we may still contact you in connection with your registered users account and communications with us.

6. USE AND DISCLOSURE OF ANONYMOUS INFORMATION. We may use Anonymous Information for any purpose and disclose such Anonymous Information to third parties in our discretion.

7. HOW WE SHARE YOUR PERSONAL INFORMATION.

A. Sharing Personal Information with Affiliates. We may share some or all of your Personal Information with our subsidiaries, joint ventures, or other companies under a common control with us (collectively, "Affiliates") or trusted service providers that perform services to maintain and operate the Site on our behalf,  in which case we will require our Affiliates to honor this Privacy Policy and we will require the service providers to perform services according to our instructions and in compliance with this Privacy Policy and any other appropriate confidentiality and security measures.

B. Sharing Personal Information in the event of Acquisition. If Karma Intelligence is acquired, merges with another entity or sells portions of its assets, our databases (which may contain your online Personal Information) will be among transferred assets. You will be notified via a posting on the Site of any such change in ownership or control of your Personal Information.

C. Disclosing Personal Information to Comply with Laws and Similar Disclosure. We reserve the right to access, use, preserve, or disclose your Personal Information when we have a good faith belief that access, use, preservation, or disclosure of such information is reasonably necessary to (1) comply with legal process, including, but not limited to, civil and criminal subpoenas, court orders or other compulsory disclosures; (2) enforce this Privacy Policy or the Terms of Use; (3) respond to claims of a violation of the rights of third parties, whether or not the third party is a user, individual, or government agency; (4) respond to customer service inquiries; or (5) protect the rights, property, or personal safety of karmadata, Karma Intelligence, our users or the public.

D. Comments and Feedback Posted to the Site. If you post any comments or feedback on the Site, you should be aware that any personally identifiable information you choose to provide there can be read, collected, or used by other users of the site, as well as other third parties, and could be used to send you unsolicited messages. Karma Intelligence is not responsible for the information you choose to submit in these forums. Please note that ideas you post, the Views you create, your account activity including, the Views you view, follow and share, and any other information you share may be seen and used by other users. Karma Intelligence cannot guarantee that other users have not made copies of and/or will not use such information outside of karmadata.

E. Sharing Personal Information on and through the Site. The information you provide or post to the Site may reveal, or allow others to identify, your nationality, ethnic origin, gender, age, and other aspects of your life. By providing information to us for the purposes of creating your user account or adding any additional details to your profile, you are expressly and voluntarily accepting the terms and conditions of this Privacy Policy and the Terms of Use that allow Karma Intelligence to process and disclose through karmadata such Personal Information.

F. Deactivating Your Profile/Account. You may withdraw your consent to karmadata’s collection and disclosure of your Personal Information at any time, in accordance with the terms of this Privacy Policy, by deactivating your profile or account. In addition, you may access, modify, or correct the Personal Information you posted to karmadata in your user profile. If you update any of your information, we may keep a copy of the information that you originally provided to us in our archives for uses documented in this policy. You may request deletion of your Personal Information at any time by contacting us. We will respond to your request within 30 days. Please note, however that your withdrawal of consent will not be retroactive and that any information related to Views you created, viewed through karmadata, any feedback or comments posted by you and any other information you shared with other through karmadata or that others have copied will still remain visible even if you request its deletion or deactivate your account.

8. CHILDREN UNDER 13 YEARS OF AGE. You should be aware that this Site is not intended for, or designed to attract, children under the age of 13 and as such, Karma Intelligence does not intentionally gather Personal Information about visitors who are under the age of 13.

9. OTHER WEB SITES. Karma Intelligence’s provision of links to other web sites on the Site is for your convenience and does not signify our endorsement of such other web sites or their content. We have no control over, do not review, and cannot be responsible for these third party web sites or their content. Please be aware that the terms of this Privacy Policy do not apply to these third party web sites.

10. SECURITY. We use reasonable measures to maintain the security of your Personal Information. However, no company, including Karma Intelligence, can fully eliminate security risks associated with the transmission of Personal Information through online transactions, and you do so at your own risk.

11. NOTICE FOR VISITORS OUTSIDE OF THE UNITED STATES. You should be aware that the United States and other countries have not harmonized their privacy regulations. Because karmadata and its servers are located in the United States, Karma Intelligence has written its Privacy Policy to satisfy United States regulations. By using the Site, you agree to the level of privacy protection set out in our Privacy Policy.

12. NOTICE TO CALIFORNIA RESIDENTS.
